Introduction

Welcome to our website. If you continue to browse and use this website, you are agreeing to comply with and be bound by the following terms and conditions of use, which together with our privacy policy govern NGC BROADBAND's relationship with you in relation to this website. If you disagree with any part of these terms and conditions, please do not use our website.

The term 'NGC BROADBAND' or 'us' or 'we' refers to the owner of the website. The term 'you' refers to the user or viewer of our website.

Internet Network (Regulations):

All definition/interpretation are to be construed and understood as per the provisions of Internet Network (Regulations) and amendment made from time to time set out herein:
  • The Applicant shall make the as per the scheme of prepaid or post paid selected by him and in case of new subscriber it should be accompanied by duly completed and signed application form.
  • The router and the accessories shall be solely used for availing services provided by NGC Broadband and shall not be used for availing services of any other Internet Network.
  • The service fees as prescribed from time to time, for each service selected by the subscriber, shall be paid in advance.
  • The package rates may change according to the applicable rules and regulations.
  • Any package will have to be subscribed for a minimum period of 6 months as per TRAI guidelines.
  • The subscriber shall take adequate care of the router while availing the services. Any willful default or damage to router will be billed to the account of the subscriber.
  • The subscriber shall not, without the prior authorization of NGC Broadband remove, transfer or otherwise relocate the router from the original place of installation.
  • In case router is lost or damaged on account of theft, burglary or by any other accident, the subscriber will file a police complaint forthwith and notify NGC Broadband of such loss immediately, with copy of complaint.
  • In case of nonpayment/delay in payment, NGC Broadband reserves the right to cancel the subscription and to discontinue the services. In such cases, the subscriber will return the router without any objection and in good working condition. NGC Broadband shall have the right to recover the balance dues and price of router in case it is not returned or is damaged or not working properly.
  • The packages fees, as prescribed from time to time for each packages selected shall be paid in advance, either to NGC Broadband or to the authorized franchisee as the case may be.
  • The subscriber shall, in advance, notify change of address/contact number to NGC Broadband or its authorized representative.
  • For reconnection/activation of the service earlier disconnected for any reason, the subscriber shall be liable to pay reconnection charges as prescribed from time to time as per regulations.
  • Internet services in respect of channels/packages shall be available to the subscriber, subject to Force Majeure conditions including but not limited to act of God, fires, strikes, embargoes, war insurrection, riots and other causes beyond the reasonable control NGC Broadband including atmospheric/topographical hindrances.
  • The router shall always remain property of NGC Broadband. The warranty of one year will cover the router components, adaptor, unless physical or willful damage has been caused to it. In case of physical or willful damage warranty will not be provided.
  • Subscribers are not authorized to install any Gadgets on router without NGC Broadband prior written permission.
  • Subscriber data can be used for marketing/promotional purposes by NGC Broadband or its associates.
  • All prices are exclusive of taxes.
  • For choosing available packages logon to company’s website. Different packages can be selected for different sets and a separate Package Application Form shall be filled for each. These packages are only for NGC Broadband Customers.


Provision of Service:

Provider makes no warranty either express or implied regarding the quality of the Internet access Service to be provided hereunder. The Internet access Service is provided on an "as is, as available" basis. Neither Provider nor anyone else involved in creating, producing or delivering the Internet access Service shall be liable for any indirect, incidental, special, punitive or consequential damages arising out of the use of the Internet access Service or inability to use the Internet access Service.
Provider has no obligation to monitor the Service; however, Provider may monitor the Service and disclose information gained from such monitoring in order to satisfy any Law, regulation or other governmental or individual request, to operate the Service and administer Provider's network, or to protect itself or its Customer.
The Internet is not a secure network and third parties may intercept, access, use or corrupt the information Customer transmits over the Internet. Provider does not warrant that files or information downloaded through the Service will be free of viruses or other disruptive code or that the Service will provide Internet access that meets Customer's needs and it makes no warranty regarding any transactions executed through the Service.

Service Termination:

NGC BROADBAND have the right to withdraw or terminate the Service without notice in the event of:
  • Any wrong or suspicious activities representation by the Customer.
  • Non payment of dues by the Customer for NGC BROADBAND's service, dishonour of cheque issued by the customer. The company reserves the right to levy penalty for cheques dishonoured, at the time of restoration of service.
  • Use of the services by the Customer for, or permission given explicitly or implicitly by the Customer, or negligence by the Customer leading to, illegal, malicious or immoral purposes.
  • Damaging NGC BROADBAND's equipment or terminal apparatus provided to the Customer for enabling the Service.
  • Any breach of the terms of this Agreement by the Customer.


Notifications

The customer agrees to receive service balance and other informative SMS sent by NGC BROADBAND from time to time on his/her mobile phone.

Packages

  • All Package are valid for 30 days.
  • Customers are requested to renew to their packages within expiry.
  • Customers can renew the Packages any time within expiry date, in that case the remaining days will be added in the next renewal.


Prices

  • Any price that is listed on the website is applicable to change.
  • Price of the offer will be applicable at the time of placing the order.
  • All the listed price includes all taxes and charges.
  • Any additional charge will be mentioned in the website.


Customer Acceptance

Customer confirms that he/she has reviewed the Terms and Conditions of NGC BROADBAND's Service Agreement hereof and has determined that the provisions hereof are suitable for Customer's needs, and that Customer has had ample opportunity to consider whether to accept this Agreement. Customer confirms that the contractual allocations of risk and reward as set forth herein shall not be disturbed or overturned by any tribunal based on any extra-contractual considerations. And Customer understands that if he/she does not agree to these Terms and Conditions and the additional provisions as set forth, Customer may not use any of the Provider's equipment or Service. Customer agrees not to assert any argument contrary to these provisions in any forum.
